What VAWA Can Offer You

VAWA was created to protect immigrants who are experiencing abuse from a U.S. citizen or green card holder who is their spouse, parent, or child. If this is your situation, you may be able to apply for a green card on your own. This petition is private, and the abuser doesn’t need to be notified. You could also be eligible for work authorization and protection from removal while your case is pending. If you’re in deportation proceedings already, you may be able to apply for cancellation of removal under VAWA, which could lead to permanent residency.

Who Might Qualify

You may be eligible if:

  • You are the spouse or ex-spouse (divorced within the last two years due to abuse) of a U.S. citizen or green card holder
  • You are the unmarried child under 21 of a U.S. citizen or green card holder who abused you
  • You are the parent of an abusive U.S. citizen child over 21
  • Your child was abused by your spouse, and your spouse is a U.S. citizen or green card holder

You’ll need to show proof of the relationship, evidence that you lived with the abuser, documentation of the abuse, and that you have good moral character. If you’re applying as a spouse, you’ll also need to show that your marriage was real, not just for immigration.
